Every Individual has a certain right that is inherent in all the individuals born as human beings irrespective of their caste, creed, colour, religion, sex, language, ideology, and nationality. The various rights of an individual begins with a birth of that person and which are necessary for human happiness and progress in life. In the real world, they faced numerous challenges from society, including not being recognized as human, but Transgender People are not exempt from claiming all inherent rights that are available to both males and females. In this paper, we will look at the categories and historical background of transgender people, how transgender people will get rights in India, and what the position of transgender people's inherent rights in India is, with a comparative analysis of other countries that recognize their inherent rights and judicial activity in relation to transgender people's rights in India.
