Abstract: They are multitude number of substantive law (rights and duties) and procedural law (execution) in the state, although the cases and the disputes are grown excess. The court has hearted and speedy trial lot of cases as long as possible. Even though bunches of civil cases pending in the court, according to the report of National Judicial Data Grid (NJDG) [11095741 civil cases] are pending more than 30 years before the district and Taluka court. What is the reason of this situation? The court not have a sufficient time to adjudication process. To overcome this tight spot MALIMATH COMMITTEE REPORT AND THE 129TH LAW COMMISSION REPORT recommend the settlement out of the court arbitration, conciliation, judicial settlement including settlement through Lok Adalat or mediation which settled the dispute after issued is frame by the court. This type of settlements reduces the court time and the cost of the parties. After that The CPC (Amendment) Act 1999 the SECTION 89 was amended in 1/7/2002. The commencement of the code, a provision was provided for Alternate Dispute Resolution. It increases the communication of the parties and also reduce the burden and the time consuming of the court. Section 89 of CPC and Article 39A of constitution imposes an obligation on the state to provide legal aid to ensure access to justice for all citizens. In the current situation the arbitration, conciliation, mediation has huge impact in the specific civil cases in the speedy world.
