| Abstract: | Maintenance rights and obligations are fundamental in ensuring financial support to dependents such as spouses, children, and elderly parents. This abstract explores the legal framework governing maintenance, emphasizing the rights of claimants and the obligations of providers under various jurisdictions. It delves into the procedural aspects of filing for maintenance, highlighting the steps involved and the necessary documentation. Remedies for non-compliance, including legal recourse and enforcement mechanisms, are also discussed. The judiciary's role in ensuring effective maintenance orders is critical, as courts interpret and enforce laws to uphold the rights of dependents. This study compares traditional maintenance laws with new criminal laws, examining their effectiveness and impact on enforcement. By analysing case laws and statutory provisions, this abstract provides a comprehensive overview of the complexities and challenges in the maintenance legal regime, aiming to enhance understanding and improve implementation for better protection of dependents' rights. |
