Abstract: Abstract The rapid expansion of digital technology has made electronic evidence an essential component of modern litigation. Courts today frequently rely on emails, CCTV footage, social media posts, call records, and other digital files in both civil and criminal proceedings. However, despite its growing significance, the admissibility of electronic evidence remains a contested issue. The principal challenges include difficulties in establishing authenticity, maintaining an unbroken chain of custody, risks of manipulation and tampering, the technical complexity of meeting certification requirements under Section 65B of the Indian Evidence Act, and the limited digital literacy among legal professionals. These hurdles often result in the exclusion of critical evidence, thereby weakening the pursuit of justice. This paper seeks to analyze these challenges and explore potential reforms to strengthen the evidentiary value of digital records. The solutions proposed include streamlining and standardizing certification procedures, establishing specialized digital forensic laboratories and expert panels to assist courts, formulating standard operating procedures for collection and preservation of electronic data, and imparting regular training in cyber forensics to judges, lawyers, and law enforcement agencies. Further, the study advocates for harmonizing Indian law with global best practices to create a more robust and reliable framework. By adopting these measures, the judiciary can ensure that electronic evidence is both credible and effectively admissible, thus reinforcing justice delivery in the digital era.
